
Night Market Vendor Health & Safety Rules
1. General Principles and Legal Compliance
1.1 Vendors must comply with the New Zealand Health and Safety at Work Act 2015 (HSWA) and related regulations.
1.2 Vendor officers are responsible for due diligence, ensuring health and safety measures are implemented, and allocating sufficient resources (staff, time, procedures) to manage risks.
1.3 The Night Market management has the right to monitor health and safety performance, including regular inspections, incident records, and corrective actions.
1.4 Vendors use facilities and equipment at their own risk. The Night Market management, its staff, and agents are not liable for accidents, injuries, or losses affecting vendors or their workers.
2. Insurance and Liability
2.1 Insurance Compliance

Vendors must not engage in activities that may invalidate or increase the insurance premiums of the Night Market management or landlord.

Vendors are responsible for any additional insurance costs caused by their actions.
2.2 Liability

Vendors are responsible for all claims, damages, and costs resulting from negligence, misuse, or improper use of facilities by themselves or their workers.
Vendors must maintain valid Public Liability Insurance to cover any third-party loss or injury during operations.
3. Risk Assessment and Site Safety
3.1 Risk Assessment

Vendors must conduct comprehensive risk assessments of their stalls and operations, identifying potential hazards (slips, fire, electrical cables, gas, burns, etc.).

Risk management should follow the reasonably practicable principle: eliminate risks where possible, otherwise isolate or control them.

For significant risks, written Safe Work Procedures must be prepared and displayed in a visible location.

Risk assessments must be regularly updated, with records of incidents or near misses.
3.2 Site Maintenance and Cleaning

Vendors must clean their areas after each market session, leaving no solid waste, grease, or spills on the ground.

All fixed fixtures, facilities, and equipment must be maintained in good condition; any damage or malfunction must be repaired or replaced immediately.

Heavy machinery or equipment may only be brought in with prior approval and must not exceed structural load limits.
3.3 Public Safety

All equipment must be securely fixed, and electrical cords safely routed to prevent tripping hazards.

Improper use of hazardous or flammable materials is strictly prohibited.
4. Employee and Child Safety
4.1 Vendors must supervise all employees, contractors, agents, volunteers, and other personnel at their stall.
4.2 Vendors must ensure that all workers receive basic health and safety training, including fire, electrical, and first aid procedures.
4.3 Minors or children must be supervised by the vendor, who bears full responsibility for their health and safety.
4.4 It is recommended to appoint a Health & Safety Representative (H&S Rep) to oversee risk management and emergency preparedness.
5. Health Management
5.1 Vendors should monitor long-term health risks, including occupational diseases, repetitive strain injuries, and fatigue management.
5.2 Chemicals, cleaning agents, and gas equipment must be safely stored, properly used, and staff must be trained in their handling.
5.3 Night operations or physically demanding tasks should allow reasonable breaks to prevent fatigue-related accidents.
6. Usage and Conduct
6.1 Vendors must not interfere with Night Market management equipment, facilities, or systems, nor engage in disruptive, obstructive, or illegal activities.
6.2 Vendors and their staff may use public areas only for access and transporting goods; solicitation, flyer distribution, or unauthorized advertising is prohibited.
6.3 Vendors must operate honestly, comply with all laws and regulations, and implement safe working practices.
7. Emergency Management and Incident Handling
7.1 Vendors must prepare an Emergency Response Plan covering fire, gas leaks, and injuries.
7.2 Evacuation routes, responsible personnel, fire extinguishers, and first aid kits must be clearly identified and accessible.
7.3 Emergency plans must be regularly practiced so that staff are familiar with procedures.
7.4 All accidents, injuries, or damages must be reported immediately to Night Market management, and vendors must cooperate with investigations and corrective actions.
7.5 Vendors must regularly inspect their stalls to identify and mitigate potential hazards, including trip hazards, equipment failure, structural risks, and electrical faults.
8. Supervision and Continuous Improvement
8.1 Health and safety management should be continuously improved: identify risks → implement controls → monitor and review.
8.2 Vendors must review their health and safety procedures at least quarterly, recording corrective actions and outcomes.
8.3 Night Market management has the right to inspect vendors’ health and safety records, including training logs, risk registers, and incident reports.
8.4 Vendors failing to comply with health and safety requirements may be required to take immediate corrective action. Serious or repeated violations may result in suspension or termination of stall licenses.
